Because there are several different ways to deal with debts depending on their type and size there may be action you can take now or in the future that may change your options and if you contact us we will apply and individual bespoke approach.

Some debts have a higher priority than others and you should not get into arrears with Mortgages, Secured loans, Hire Purchase, Rent, Council Tax, Utilities, Magistrates fines etc just so you can pay your unsecured loans credit and store cards.

If you have already started to miss or make late payments and are trying to deal informally with matters yourself you may have already found some creditors or their representatives can be difficult to deal with.

  • Do not make agreements you cant keep to.
  • If you reach an agreement ensure the payments are made on time.
  • Keep a record of who you have paid what and when.
  • If asked to complete any income and expenditure forms make sure they are accurate and you can provide supporting evidence if necessary.

Some may be quick to threaten or use Default Notices Court action Bailiffs or even Bankruptcy. All these threats must be taken seriously however taking the right action quickly can resolve the situation before matters start to get out of hand.

For Your Protection

To protect consumers there are government acts and regulation making harassment by a creditor or their agent a criminal offence and if found guilty they may face criminal proceedings, a fine and loss of their consumer credit license stopping them trading.

You do have rights and there is action you can take but this is a complex area and whilst creditors are quite rightly allowed to try and recover money they are genuinely owed  they must behave in a responsible way.

For example under section 40 of The Administration of Justice Act certain activities by a creditor or their agent are not allowed and a code of practice was issued by the Office of Fair Trading.

Examples of these are as follows:-

  • Harassing debtors with demands for payments with a frequency calculated to cause alarm, distress or humiliation.
  • Pressurising debtors to sell property or raise funds by further borrowing
  • Disclosing indebtedness to third parties especially neighbours relatives or employers.
